Promoted Placement Prize Draw, Nov '24 T+Cs

Terms and Conditions

1. These terms and conditions (“Terms and Conditions”) apply to the “JUST EAT Promoted Placement Prize Draw” promotion as described below (the “Promotion”).
2. The Promotion will only be open to UK-based Restaurant Partners (“RP” or “Entrant”) who purchase or top up Promoted Placement on JUST EAT (PP), except employees of JUST EAT, their associated, affiliated or subsidiary companies, and their families, agents, or anyone connected with the Promotion.
3. Eligible RPs will not have ever had PP running, or have not had PP running for the past 6 weeks prior to 14th October 2024.
4. By buying PP the RPs, entrants agree these Terms and Conditions will apply to the Promotion. These Terms and Conditions will not affect the PP terms and conditions applicable to the PP service itself and which are available [here].
5. Entry into the Promotion is free for all eligible RPs. To be eligible to enter the Promotion and have a chance to win a Prize, a RP must do all of the following to be included in the prize draw: 

• purchase at least one postcode for your recommended budget shown in the Partner Hub, which you cannot decrease during the month it has been purchased for (a ‘’Qualifying Campaign’’); and
• Book a Promoted Placement campaign at 80% or more of your recommended budget  . Once you set up the budget you can’t decrease your budget for that calendar month.

6. To be automatically entered into the  Prize draw, RPs must fulfil the Eligibility Criteria and have purchased or topped up PP between 1 November 2024 (00:01) and 30 November 2024 (23:59);
7. A total of 85 winners will be randomly selected to be each awarded one of the following (“the Prizes”):

a) 10 x Just Eat commission holidays for the month of December 2024. This means Just Eat will pay you back for any commission taken from you in December in the form of a rebate. Value capped at £1,500

b) 25 x Huggg vouchers worth £25

c) 50 x Just Eat branded hot food bags with an RRP value of around £10

8. Each RP can win a maximum of one Prize. 
9. No matter how many postcodes a RP purchases, they will be entered in the prize draw only once.
10. Winners of the Just Eat commission holiday will have their commission repaid in the form of rebate for the month of December, which will be paid to them on or before their last invoice in January 2025. 
11. Hot Food Bags will be delivered within 10 working days of winners being notified.
12. Where the Prize awarded contains a voucher for Huggg, the redemption of those vouchers will be subject to the Huggg terms and conditions detailed here and any additional terms and conditions applicable to the Huggg voucher communicated to the relevant winner at the time the voucher is issued.
13. The prize draw will take place on 9 December 2024. Just Eat will notify winners by email within 5 working days following the day of the Prize Draw with details on what they have won and how that Prize can be redeemed.
14. A winner should consult their own tax advisor regarding the tax consequences of winning a Prize as won Prizes may need to be declared to the tax authorities.
15. Any gambling taxes due in respect of this Promotion are for the account of the Promoter.
16. Prizes are subject to availability. Just Eat retains the right to substitute the Prizes (or any part thereof) with another prize of equivalent or higher value in the event the original Prize(s) offered are not available, or due to an event beyond the reasonable control of Just Eat (including but not limited to where the Prize is withdrawn by the provider of that Prize before the Prize Draw takes place). 
17. Prizes cannot be transferred, sold or exchanged and there is no cash alternative (in whole or in part).
18. Winners are strictly prohibited from selling their Prize to any other third party.
19. Maximum of 1 entry per Prize Draw (and 1 Prize) per eligible Restaurant Partner.
20. Purchases of Promoted Placement prior to or after the Prize Draw will not count towards an entry to the Promotion.  
21. Just Eat reserves the right to withdraw or suspend the Promotion at any time without prior written notice and/or to alter or amend these Terms and Conditions at any time, without liability to any entrants.
22. Just Eat accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by an entrant or his/her/their  accompanying companions as a result of entering the Promotion or accepting any Prize. 
23. Nothing in these Terms and Conditions shall exclude the liability of Just Eat for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.  
24. Just Eat reserves the right to disqualify any Entrant it believes not to be in compliance with these Terms and Conditions, the Promoted Placement Terms and Conditions, or not participating within the spirit of the Promotion or suspects of participating in any unfair or unjust behaviour.  Just Eat reserves the right to use their discretion in all respects and to enforce any penalty or sanction they deem appropriate.   
25. Just Eat may collect personal information from Entrants, for example, information provided during the course of the Promotion. Just Eat will use Entrants’ information for the purposes of the administration of this Promotion.  By entering the Promotion, and accepting these Terms and Conditions, the Entrant consents that the Promoter (and its group companies) may process personal data that we collect from you in accordance with these Terms and Conditions, our privacy policy available here and the UK Data Protection Act 2018.). 
26. By entering the Promotion, and accepting these Terms and Conditions, the Entrant consents that the Promoter may use their details, restaurant name and images in marketing activities. Furthermore, the Entrant agrees to share images of themselves with the Prize at the request of Just Eat.
27. In the event of any dispute, the decision of Just Eat and its appointed representatives is final in all matters (including any not covered by these Terms and Conditions) and no correspondence shall be entered into. 
28. These terms and conditions and any dispute or claim (including a non-contractual dispute or claim) arising out of or in connection with these terms and conditions shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts. 
29. The Promoter is Just Eat.co.uk Limited (company number 04656315), whose registered office is at Fleet Place House, 2 Fleet Place, London, EC4M 7RF.
